By accessing and using ocms.tech (the "Site") and downloading or using the Opossum CMS software (the "Software"), you agree to comply with these Terms & Conditions ("Terms") and all applicable laws and regulations. The Opossum CMS Software is provided under the GNU General Public License v3.0 (GPLv3). This means:

Intellectual Property Rights
Ownership

User-Generated Content
Your Responsibility

- Not submitting malicious code or vulnerabilities (except through responsible disclosure)
Our Rights

- Punitive Damages: Any penalty damages
Direct Damage Cap: Even if we are found liable for direct damages, our total liability shall not exceed the amount you paid to us (which is likely $0, since the Software is free).
Essential Service Limitation
If you're using oCMS for a critical or essential service, you are solely responsible for:
- Implementing redundancy and failover mechanisms
- Maintaining backups
- Testing disaster recovery procedures
- Obtaining appropriate insurance coverage
Indemnification
You agree to indemnify and hold harmless the oCMS project, its contributors, maintainers, and operators from any claims, damages, or costs arising from:

- Your violation of any law or third-party rights

- Your modifications to the Software

Termination
Right to Terminate
We may, at our sole discretion, terminate or suspend your access to the Site if you:

- Engage in illegal activity
- Harass, abuse, or threaten others
- Post malware or malicious content
Termination may be immediate and without notice for severe violations.
Effect of Termination
Upon termination:
- Your right to use the Site is immediately revoked
- Your account and content may be deleted
- Our licenses and obligations cease
- Limitation of Liability and Indemnification survive termination
Software Use After Termination
If your Site account is terminated, you may still use the Software under the GPLv3 License (unless the termination is for license violation).
Governing Law & Jurisdiction
These Terms are governed by the laws of the jurisdiction where the primary oCMS maintainers are located, without regard to conflict of law principles. Since oCMS is an international open-source project, disputes may be resolved through:
- Negotiation: First, try to resolve disputes directly via email
- Informal Dispute Resolution: If negotiation fails, consider mediation
- Binding Arbitration: For disputes that cannot be resolved informally, either party may pursue binding arbitration (see Dispute Resolution)
Jurisdiction Note
Because oCMS operates internationally and you may be in any jurisdiction, we prefer to resolve disputes outside formal courts when possible. However, either party may pursue legal action in the courts of their respective jurisdictions.
Dispute Resolution
Steps for Resolving Disputes
- Contact Us: Email webmaster@ocms.tech with your concern. Include detailed information about the dispute.
- Negotiation: We'll work with you in good faith to resolve the issue (typically 30 days).
- Escalation: If unresolved, either party may escalate to formal mediation or arbitration.
- Arbitration: Binding arbitration will be conducted according to rules agreed upon by both parties.
No Class Actions
You agree that any arbitration or legal action is on an individual basis. You may not pursue class action claims or consolidate multiple claims. This protects both users and the oCMS project from frivolous lawsuits.
Injunctive Relief
Notwithstanding arbitration, either party may seek injunctive relief (cease-and-desist) in court for violations of intellectual property rights or confidentiality.
Changes to Terms
We reserve the right to update these Terms at any time. Changes become effective when posted to this page. Material changes will be announced via:
- A prominent notice on the Site
- Email notification (if you're subscribed to updates)
- A new version number with date
Your continued use of the Site or Software after changes implies acceptance of the updated Terms. We recommend reviewing these Terms regularly (at least annually).
